Criteria for Assessing Efficacy of Contracts and Economic Development Subsidies
In Gulf Coast Relief, Recovery, and Reconstruction

A. Contracting Standards

  1. Were contracts fairly solicited and competitively bid?
  2. Were contractors chosen by merit, including evidence of fair labor practices?
  3. Were single contractors awarded more than $10 million?
  4. Were contracts let before “justification” was written and accepted for no-bid awards?
  5. Were contracts let to corporations with a record of waste, fraud, or abuse?
  6. Were contracts let to businesses with unjustified, unreasonable, questionable, or unsupported expenditures?
  7. Were contracts let to or revoked from businesses with citings of deficiencies in business systems?
  8. Were contracts denied to businesses with prior serious violations of the wage and hour provisions of the Fair Labor Standards Act, health and safety violations of the Occupational Safety and Health Act, or collective bargaining violations of the National Labor Relations Act?
  9. Did federal contracting agency staff fully comply with Fair Acquisition Requirements (FAR) during the contracting process?
  10. Are all names and levels of subcontractors publicly listed?
  11. Were any contract oversight activities, “inherently government functions,” (Subpart 7.5 of Part 7 – FAR) outsourced to non-governmental entities?

B. Economic Development Subsidy Standards

  1. Are provisions included to safeguard taxpayers such as clawbacks (money-back guarantees by contractors to insure work that has been paid for is completed), job quality standards, and transparency?
  2. Are subsidies structured to serve the public good by primarily helping restore local jobs and family incomes for local residents?

C. Employment and Community Benefits Standards for Both Contracts and Subsidies

  1. Was preference given to local contractors and subcontractors?
  2. Was preference given to “first source” hiring of local workers?
  3. Were On-the-Job Training (OJT) and certified apprenticeship program opportunities for displaced Gulf Coast youth included in contract and subsidy language?
  4. Were prevailing wages paid?
  5. Was fair health care coverage provided?
  6. Was an Affirmative Action plan developed and complied with?
  7. Did the workplace comply with wage and hour provisions of the Fair Labor Standards Act, health and safety provisions of the Occupational Safety and Health Act, and collective bargaining provisions of the National Labor Relations Act?
  8. Did employers provide adequate housing for workers?
